This Charter shall regulate the activities of the legal entity, a non-profit organization, formed to be duly organized and to exist under the laws in the capacity of a social organization-political party, hereinafter referred to as the Party.

Full name of the Party in English: Republican People's Party of Kazakhstan

Shortened name in English: RPPK

The Republican People's Party of Kazakhstan shall be a voluntary social organization of Kazakhstan citizens, formed to provide for their organized participation in the political life of the society, facilitate the cognizance, formation and implementation of their representatives in exercising the powers of the state. The duration of the Party shall be perpetual.

AIMS AND OBJECTIVES OF THE PARTY

The aims of the Party shall be in accordance with the Party Program drown by the Incorporation Convention and shall be as follows: build a lawful State based on the principle of socially oriented market economy, democracy, unconditional non-violation of human rights and freedom of the people; provide dynamic development of the country by setting up effective economic and political systems; improve the standard of living of the citizens through political and economic reforms; come to power by constitutionally recognized means, provide and protect the vital interests of the people of Kazakhstan. To achieve the goals indicated above, the Party shall, in accordance with the legislation in force, carry out the following activities which shall constitute its object:

• actively participate in presidential, parliamentary, local government, self-regulation elections by nominating its representatives as candidates, spread information regarding its activities, goals and objectives;
• may voluntarily unite with other social organizations and parties into associations (unions) and electoral constituencies;
• may join the membership of international non-profit non-governmental organizations;
• found printing, mass media, engage in publishing, hold meetings, strikes, demonstrations and pickets;
• represent and protect the rights and legal interests its members in courts of law, other government agencies and before other social organizations;
• engage in entrepreneurship within the scope prescribed by the Law of the Republic of Kazakhstan regarding Social Organizations, found business partnerships, institutions, and public foundations;
• carry out charitable acts;
• carry out other activities that do not violate the laws of the Republic of Kazakhstan.

PARTY MEMBERSHIP

Party membership shall be voluntary and reviewed individually. The Party may admit to membership any citizen of the Republic of Kazakhstan who shall have attained to the age of 18 years, paid the admission fee and shall be paying membership dues on a regular basis, share the program goals and adhere to the Party Charter. Military officers, workers of law enforcement and national security agencies, and judges shall not be eligible for party membership.

A Party member who has been elected as President of the Republic of Kazakhstan shall discontinue involvement with party activities for the period of their term of office. A Party member shall not be a member of another political party at the same time.

LEGAL STATUS OF STRUCTURAL SUBDIVISIONS.

"The Organizational structure of the Party shall be based on territorial principles. The Party activities shall cover entire territory of the Republic of Kazakhstan where its branches shall be formed to unite the primary party organizations. Regional Party organizations shall constitute separate structural subdivisions of the Party, that is branches, and shall operate on the basis of the Branch Clause which shall be ratified by the Party convention. The decision to form, reorganize or terminate the activities of regional branches shall be taken by the Party Convention.

MANAGEMENT

The Supreme Agency of the Party shall be the Convention (Congress) which shall be called not less than once every two years. A special Party Convention may be called by the decision of the Central Council or by the requirement of more than half of the branches. The Party Convention shall;

• draw the Party Program and Charter, introduce thereto amendments and substitutions;
• elect the Party Chairman, Central Council Central Control and Auditing Commission;
• nominate Party member as candidates for Presidential and parliamentary elections of the Republic of Kazakhstan; set forth the Party pre-election platform; take decisions concerning the formation, reorganization and termination of branches;
• ratify the Branch Clause;
• veto the decisions of the Central Council or Executive Committee in the event of their violation of the operating laws, this Charter or the Party Program;
• take decisions regarding the reorganization or termination of the Party.

THE CENTRAL COUNCIL

The Central Council shall be the coordinating organ of the Party during the interval between its Conventions, and shall be elected by the Party Convention for a term of two years.

The Central Council shall:

• Call annual and special Party Conventions;
• Determine the standards of representation, order and duration of the Convention;
• Appoint the Chairman of the Executive Committee of the Party from the Central Council members;
• Ratify the composition of the Executive Committee presented by the Chairman of the latter;
• Veto the decisions of the Executive Committee in the event of their breach of the operating laws; this Charter of the Party Program;
• Ratify the size and order of paying admission fees and membership dues;
• Ratify the structural and staff schedule of the management organs of the Party.

THE PARTY CHAIRMAN

The Party Chairman shall be the highest in rank of all the party officials, and shall represent it in relation to other parties, social organizations, government organizations, Agencies and their officials both at home and abroad. The Party Chairman shall be elected by the Party Convention from its members for a term of two years, and may be removed from office solely by the decision of the Convention. The Party Chairman shall sign documents put forth by the Party Convention or its Central Council or drawn on behalf of the Party, shall preside at Conventions, Central Council meetings and other activities conducted by the Party.

THE EXECUTIVE COMMITTEE OF THE PARTY

The Executive Committee of the party hereinafter the Executive Committee shall be ratified by the Central Council members and other party members presented by the Executive Committee Chairman for a turn of office no longer than the term of the Central Council. The Party Executive Committee shall:

• organize the implementation of the resolutions of the Convention, Central Council, and the commissions of the Party Chairman;
• be in charge of the regional party organizations (branches);
• conduct conferences, round tables, seminars and other relevant activities;
• constitute the permanently operating management organ of the party, exercising the authority of a legal entity on its behalf;
• work out and distribute operation recommendations for the branches and primary party organizations.

(Checks and balances)

The agency of control for the party shall be the Central Control and Auditing Commissions, hereinafter referred to as CCAC, which shall comprise three people elected from the party members at the Convention for a term of three years.

• The Party and the Youth;
• Youth groups such as clubs, circles, sessions etc. Operating on the basis of the standards of their Charter, the Party program and their own documents of incorporation, may be organized under the Party;
• Citizen's of the Republic of Kazakhstan who shall have attained to the age of 16 years may be admitted to the membership of the youth groups under the Party.

THE PRINTING AGENCIES OF THE PARTY

ITS SYMBOL

The party shall have the right to establish its own printing agencies in accordance with the laws of the Republic of Kazakhstan. The party shall have its own symbol in the form of an emblem the description of which follows below. The emblem shall be a picture of a blue soaring hawk on a yellow oval background with the following inscription in Kazakh and Russian, separate property, may enter into contracts and agreements, acquire property and non- property rights, bear relevant responsibilities, sue and be sued in a court of law.

Party property shall constitute languages: Republican People's Party of Kazakhstan (Appendix N1 to this Charter). The party may have a Party member's badge with a reproduction of the emblem on it.

ECONOMIC ACTIVITIES OF THE PARTY

The party shall be a legal entity according to the laws of the Republic of Kazakhstan starting from the date of its registration by the relevant government agencies; shall have the independent balance, bank accounts, and belongings necessary for the material provision of the activities prescribed by this Charter except objects prohibited by the laws of the Republic of Kazakhstan.

The monetary funds of the party shall be raised from the admission and membership fees, voluntary contributions and donations of legal entities and national persons, the Charter, lotteries, income from entrepreneurial and publishing activities, and other receivable from acts not forbidden by law.
